Seasonal unemployment occurring as a result of activity practiced in a seasonal sector
Are considered as seasonal sectors :
- logging;
- leisure and holiday centres;
- professional sports;
- seasonal activities related to tourism;
- seasonal agricultural activities;
- casinos and gaming circles.
This first type of unemployment qualifies the unemployed who have carried out an activity in these sectors in the 3 years before the end of his employment contract.
Compensation for this type of seasonal unemployment
This seasonal unemployment opens a right to unemployment, called return-to-work assistance allowance (ARE). But this allowance will be reduced by a coefficient determined by the volume of activity over the past 12 months. However, this rule is not applicable if the unemployed person has never received unemployment insurance benefits or if this seasonal activity is linked to fortuitous circumstances.
Seasonal unemployment: unemployment occurring 3 years in a row during the same periods
seasonal unemployment resulting from the pace of activity and not from the sector opens the right to unemployment benefits reduced depending on the volume of activity over the last 12 months.
However, the rules on seasonal unemployment will not apply :
- if the periods of inactivity do not exceed 15 days or are linked to fortuitous circumstances;
- if the unemployed person has never received unemployment insurance benefits;
- if the unemployed person is aged 50 or over and has worked for 3 years in the last 5 years.
Compensation for this type of seasonal unemployment
The seasonal coefficient reducing unemployment benefits is calculated by dividing by 365, the number of days of activity in the 13 months preceding the end of the employment contract. The coefficient obtained is then multiplied by the unemployed person’s daily reference wage. Part of this variable result according to the level of gross monthly salary will be paid by the employment center to the unemployed. In addition, reinforced support is provided by the latter to enable lasting integration into the job market.
To know : if the seasonal unemployed person resumes a short-term activity, the situation is not changed.
To note : the trade unions of seasonal ski lift and slope service workers went on strike in February 2011, in particular to demand the abolition of the reduction coefficient applied to seasonal unemployed workers.
