What is partial unemployment?
Partial unemployment is a method to which the company resorts when it reduces its activity below the legal working hours or temporarily stops all or part of its activity and it does not wish to break the employment contracts which relate to its employees. It can also be defined as technical unemployment.
The short-time work compensation system makes it possible to manage a one-off drop in activity, limited in time and having as its framework the calendar year.
Partial unemployment or technical unemployment can result in:
- a partial reduction of activity ;
- a full stop business activity for a certain period.
Whatever the situation, the compensation system is based on several allowances which complement or follow one another and which are financed by the employer, by the State and, possibly, by the Pôle emploi in the event of complete cessation of work. activity.
Partial unemployment benefit
In the event of a reduction in activity, the unemployment benefits to compensate for the loss of salary are as follows:
- I’state-funded specific allowance. In 2013, it amounted to €4.84/h for companies with less than 250 employees and €4.33/h for those with more than 250 employees, on the basis of 600 hours;
- I’planned conventional allocation. This is an allowance financed by the employer, or possibly the State within the framework of the FNE agreements. The company pays the employee 60% of the gross hourly wage with a minimum set at €6.84 for each hour not worked.
To note : the employee receives a single allowance. The conventional allowance is paid by the employer, the latter then being reimbursed for the specific allowance at the expense of the State.
What is full unemployment?
Total partial unemployment, which is also called complete unemploymentcorresponds to a temporary total cessation of activity. He is eligible for compensation under the unemployment compensation system described above, for a maximum of 28 days. It results in redundancies.
Right to full unemployment
After this timeinterested parties will be considered to be at the look for a job. The employment center can then take over and pay unemployment benefits, although the employment contract is not broken, for a maximum period of 182 days.
The intervention of the Pôle emploi is therefore only possible after 28 days of total partial unemployment. The amount of the allowance paid then varies from 75% to 57% of gross monthly salary according to his level.
The maximum duration of compensation is 182 days. However, when the suspension of the company’s activity is attributable to a disaster or a natural disaster, the compensation may, exceptionally, continue until the scheduled date of resumption of activity of the company. .
