Terms of conventional termination
The conventional termination allows the employee and the employer to agree on the breaking conditions of the employment contract.
It involves a specific procedure (interviews between the two parties, design of a termination agreement, reflection period, etc.) and allows the employee to benefit from unemployment benefit.
According to these terms, the contractual termination only concerns permanent contracts.
Termination by mutual agreement of a CDD
In the context of a fixed-term contract, it is possible for the employee and the employer to terminate the employment contract of a agreement.
A writing clearly indicating the will of both parties to break the contract is then necessary and must bear both signatures.
The employer will then have to pay the end-of-contract indemnity (precariousness premium) to the employee.
