Recruitment of non-permanent agents
Non-permanent agents are recruited into the civil service:
All the local authorities recruit contract workers, particularly in the sectors of communication, management control, new technologies, town policy, local economic development and IT.
To know : contractors are not governed by civil servant status or public labor law.
The law on access to tenured employment and the improvement of employment conditions for contractual agents in the public service was published in the Official Journal on Tuesday 13 March 2012.
This law puts in place for 4 years, a special mechanism for access to tenured employment for contractual civil servants (the objective being in particular to enhance professional experience). For agents who do not wish or cannot obtain the status of civil servant (because of the conditions of nationality, for example), this law provides, under certain conditions, for the reclassification of their contracts as permanent contracts.
A CDD cannot be renewed for more than 6 years, beyond which it will be requalified as a CDI. Any interruptions of contracts of less than 3 months will no longer justify the conclusion of a new fixed-term contract or the renewal of fixed-term contracts rather than permanent contracts, when the agents meet the required seniority conditions. In addition, CDIs may be entered into directly.
To know: Access to internal competitions is open to contract workers after a number of years of work defined in the specific statutes of each employment group (4 years for category A competitions).
- By path to careers in the territorial, hospital and State public service
The PACTE allows young people aged 16 to 25, whose level of qualification is below the baccalaureate and without a recognized professional qualification, to access a category C job in the civil service without having to take a competitive examination.
This is a public law contract, signed for a period of between 1 and 2 years and accompanied by a trial period of 2 months.
Interested young people should contact the Pôle Emploi agency responsible for their place of residence, which checks whether they meet the conditions for benefiting from a PACTE.
- Employment of people with disabilities
Some disabled people who have the same diplomas or levels of study as those required for candidates for external competitions may be recruited without competition in category A, B and C jobs and then made permanent, after a certain period of employment. .
Agents receive remuneration equivalent to that enjoyed by trainee civil servants from civil service competitions.
Use of temporary employees
The administration can also use temporary workers in 4 main situations:
- the replacement of a civil servant or non-permanent agent who is temporarily absent;
- the temporary increase in activity requiring additional manpower;
- the occasional or seasonal need for specific technical knowledge;
- the temporary filling of a vacant post which cannot be filled immediately by an official or non-permanent agent.
