What does the part-time employment contract contain?
The part-time employment contract must be concluded in writing. Otherwise, the employee is considered as a full-time employee. The contract must contain the mentions following:
- function occupied by the employee;
- remuneration ;
- working time per week or per month;
- distribution working hours;
- limited use of overtime;
- methods according to which the employee is informed of his working hours (in the event of a change);
- conditions of possible modification of the schedules.
How many hours must the employee work?
Since January 1 2014the employment contract must include a minimum of 24 hours a week (or an equivalent monthly duration).Exceptionallyit is possible to reduce this working time when:
- the employee is a student and is under 25;
- the employee faces significant personal constraints;
- the employee has several part-time employment contracts;
- the employee is hired by an individual;
- the collective agreement in force or the branch agreement provides for it. In this case, the schedules must be regular and grouped into full days or half-days.
The distribution of schedules is controlled. Unless there is a company agreement providing otherwise, the employee cannot be subject to more thanan interruption of activity in the same working day, and this interruption cannot be greater than 2 hours.
How does the part-time work contract end?
The part-time employment contract concluded for a determined time take automatically end on the date indicated in the contract. Early termination by the employer can only be based on serious misconduct by the employee. At the end of the contract, allowances representing 10% of his total gross remuneration are paid to the employee. The part-time employment contract concluded for a indefinite period follow the same rules of rupture than those applicable for a full-time contract:
- both parties agree together to terminate the contract;
- the employee resigns;
- the employer proceeds with a dismissal for fault or for economic difficulties.
