Note: working hours lost as a result of non-work or unemployment on public holidays do not give rise to recovery.
Article L3133-3 of the Labor Code specifies that “unemployment on public holidays cannot result in any loss of salary for employees totaling at least three months of seniority in the company or establishment and having completed at least two hundred hours of work during the two months preceding the holiday in question, subject, for each employee concerned, to having been present on the last working day preceding the holiday and the first working day following it, except leave of absence previously granted.
These provisions do not apply to employees working from home, seasonal employees, intermittent employees and temporary employees.
If a public holiday falls during the employee’s leave, then the leave is extended by 24 hours. For more information see our fact sheet on paid leave.
