When does work accident compensation start?
The day on which the work accident giving rise to compensation occurs is fully paid by the employer. Compensation does not start until the next day, without waiting period.
In order for the daily allowances to be paid by the CPAM, the employer must complete form no. S6202 “Salary certificate – accident at work or occupational disease”. He can do this online or by obtaining the form from the CPAM.
Once the process is initiated, the CPAM is responsible for calculating the daily allowances that must be paid to you. They will be paid every 14 days, for the duration of the work stoppage. The payment of daily allowances ceases, either when the injury heals or consolidates.
Note: consolidation is the fact of considering a lesion as stabilized. It is then considered to be permanent insofar as it is not likely to change in the short term.
Calculation method for daily allowances
Daily allowances are calculated based on gross salary affected the month preceding the accident at work.
To calculate your allowances, you must start by calculating your basic daily salary, which corresponds to the gross salary divided by 30.42. It is a percentage of this amount that will be paid to you as compensation. Compensation is limited to one maximum amount which cannot exceed the net daily reference wage.
The daily allowance paid by the CPAM to the injured worker will change over time according to the scale indicated in the following table:
Stop duration |
Percentage of basic daily salary |
Maximum amount of compensation (per day) |
From day 1 to day 28 of sick leave |
60% |
€187.89 |
From day 29 |
80% |
€250.52 |
Note: if the work stoppage is longer than 3 months, the daily allowances can be increased in the event of a general salary increase, either by ministerial order or within the framework of a collective agreement.
Daily allowances are taxable at 50% of their amount, as is the case with wages. In addition, you must keep the daily allowance statements for an indefinite period since they validate your pension rights.
