Who can apply for vocational training leave?
Vocational training leave can be requested by:
- the official incumbent. He must have a seniority of at least 3 years at his post;
- the contract agent. He must have completed at least 3 years service (consecutive or not) in the public service. The employee hired by a local authority must also have exercised at least 1 year within the community in question. State employees are also subject to the same obligation.
Officials must be able to justify a reason, namely the existence of a professional or personal project.
How do I request vocational training leave?
The request for leave must be formulated within a certain time limitwhich differs according to the status of the employer:
- 2 months before the start date of the training, for hospital officials;
- 3 months before, for territorial civil servants;
- 4 months before, for state officials.
The request is made in writing and precise the dates beginning and end of the leave, the training chosen and the contact details of the training organisation. The administration has a period of 30 days to answer. Its refusal can only be based on the ” service necessities “. On the second refusal (for the territorial public service) or on the third refusal (for the state and hospital public service), the opinion of the Joint Administrative Commission is mandatory.
What happens during and after the leave?
The maximum duration of leave is set at 3 years over an entire career. The civil servant can request to benefit from it all at once, or split the leave (within the limit of one month minimum). The civil servant is paid by his administration during the first year off. If he is unable to provide proof of his attendance training, he loses his right to leave and must reimburse the allowances he has received. When he reinstates position, the employee owes his administration a obligation to service which cannot be less than 3 times the duration of the leave. If he does not comply, he is obliged to reimburse the sums received in proportion to the period of work not carried out.
